Terms of Service

Effective date: August 18, 2025

These Terms of Service (“Terms”) govern your access to and use of Hetki (the “App”, “Service”). By creating an account, downloading, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Our story

2. Eligibility

Hetki is intended for users aged 16 and older. You must be at least 16 years of age to use the Service. If you are under 16, you may not use the Service. By using the Service, you represent that you are at least 16 years old, can form a binding contract with us, and will comply with these Terms and applicable laws.

3. Accounts

  • You are responsible for your account, credentials, and all activity under it.
  • Provide accurate information and keep it updated.
  • Notify us promptly of any unauthorized use or security breach.

4. Health & safety notice (no medical advice)

  • The Service provides wellness and meditation content for informational and educational purposes only. It is not medical advice, diagnosis, or treatment.
  • Consult a qualified healthcare professional before starting or changing any wellness or meditation practice, especially if you have a medical condition, are pregnant, or have mental health concerns.
  • Stop any activity that causes discomfort, pain, or distress. Do not use the Service while driving or in situations requiring your full attention.
  • The Service is not designed for emergencies. In an emergency, call local emergency services immediately.

5. Your content

  • You may submit information such as preferences, goals, notes, or feedback (“User Content”). You retain any rights you have in your User Content.
  • You grant us a worldwide, non‑exclusive, royalty‑free license to host, store, process, adapt, and display User Content solely to operate, improve, and provide the Service.
  • You represent that you have all rights necessary to submit User Content and that it does not infringe or violate others’ rights or laws.

6. Generated content

  • The Service may generate scripts, audio, summaries, or suggestions based on your inputs (“Generated Content”). Generated Content is provided “as is” for personal, non‑commercial use.
  • We do not guarantee accuracy, completeness, or fitness for any purpose. You are responsible for how you use Generated Content.
  • Subject to your compliance with these Terms, we grant you a personal, non‑exclusive, non‑transferable license to use Generated Content within the Service for your own wellness and meditation practice.

7. Acceptable use

You agree not to:

  • Use the Service for unlawful, harmful, or abusive activities, including harassment or infringement.
  • Attempt to reverse engineer, scrape, or circumvent security or rate limits.
  • Upload malicious code or interfere with Service operation or networks.
  • Misrepresent your identity or the source of content.

8. Intellectual property

We (and our licensors) own all rights in the Service, including software, interfaces, designs, logos, and content provided by us. Except for the limited licenses expressly granted to you, no rights are transferred.

9. Third‑party services

The Service relies on and integrates with third‑party services to provide functionality, including hosting, authentication, AI-powered content generation, text-to-speech conversion, subscription management, payment processing, error monitoring, and health data integration. Each third-party service's terms and privacy practices govern your use of those services. We are not responsible for third‑party services, their availability, or their handling of data beyond our Data Processing Agreements with them.

10. Subscriptions and payments

Subscription requirement

Hetki requires an active paid subscription to access app features. We offer monthly and annual subscription plans with pricing displayed at the time of purchase.

Billing and auto-renewal

  • Subscriptions are billed through the Apple App Store or Google Play Store and processed by our payment provider (RevenueCat).
  • Your subscription will automatically renew at the end of each billing period (monthly or annual) until you cancel.
  • Payment is charged to your App Store or Google Play account at confirmation of purchase.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Pricing may change with notice. Changes apply to new or renewing subscriptions.

Free trials

We may offer free trial periods for new subscribers. If you do not cancel before the trial ends, you will be automatically charged for a subscription. Trial eligibility is determined by the App Store and may be limited to one per user.

Cancellation

  • You may cancel your subscription at any time through your App Store or Google Play account settings.
  • Cancellation must be completed at least 24 hours before your renewal date to avoid being charged.
  • After canceling, you will retain access until the end of your current billing period.
  • No partial refunds are provided for unused portions of a subscription period.

Refunds

Refund requests are handled according to the App Store's or Google Play Store's refund policies and applicable consumer protection laws. Contact Apple or Google directly to request a refund. We do not process refunds directly.

Payment information

We do not collect or store your payment card details. All payment processing is handled by Apple, Google, or our payment processor. See our Privacy Policy for details on what subscription data we collect.

11. Privacy

Your use of the Service is subject to our Privacy Policy, which explains in detail:

  • What data we collect (account information, meditation sessions, analytics, health data with your consent, subscription data, and technical data)
  • How we use your data (to personalize your meditation experience, manage subscriptions, improve the Service, and ensure security)
  • How we share data with third-party service providers (including specific details about what data goes to which services)
  • Your rights and how to exercise them (access, correction, deletion, data portability, consent withdrawal)
  • How we protect your data (encryption, authentication, Row Level Security, and other security measures)
  • Data retention periods and what happens when you delete your account

Important note about health data: If you choose to connect Apple Health, we collect health and biometric data (heart rate, HRV, sleep data, mood tracking) only with your explicit consent. You can control both collection and sharing independently, and you can withdraw consent at any time. We never share exact biometric values or personally identifiable information with AI providers—only anonymous aggregated insights.

12. App store terms

If you download the App from an app store, you also agree to the app store’s terms. The app store is not responsible for support or claims related to the App.

13. Service changes and availability

We may change, suspend, or discontinue any part of the Service at any time. We are not liable for any unavailability or modification.

14. Termination

We may suspend or terminate your access if you violate these Terms or if needed to protect the Service or other users. You may stop using the Service at any time. Certain provisions survive termination (e.g., IP, disclaimers, liability limits).

15. Disclaimers

THE SERVICE AND GENERATED CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) USD $50.

17. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your User Content, or your violation of these Terms or applicable law.

18. Governing law and venue

These Terms are governed by the laws of Finland, without regard to conflict‑of‑law rules. You agree to the exclusive jurisdiction of the courts located in Helsinki, Finland, unless applicable law requires otherwise.

19. Changes to these Terms

We may update these Terms. We will post the updated version with the “Effective date” above and, where appropriate, notify you in the App. Continued use means you accept the changes.
